Contest Rules
1. How to Enter
Simply go to the http://www.swellwomen.com website and enter your
contact information. (Don't worry, we have a strict Anti-Spam policy
and will never sell, rent or otherwise give away your email
or any other private information.)
2. Eligibility
The Sweepstakes is open to men and women ages 18 years of age by January
1st, 2006. By participating, entrants agree to abide by these Official
Rules, including all eligibility requirements, and the decisions of
SwellWomen. All of SwellWomen's decisions are final and binding in
all respects. In the event of a dispute as to the identity of an online
entrant, entries made online will be deemed made by the authorized
account holder of the e-mail address submitted at the time of entry.
A Potential winner may be required to show proof of being the authorized
account holder for that e-mail address. "Authorized account holder"
is defined as the natural person assigned to an e-mail address by
an Internet service provider, online service provider, or other organization
responsible for assigning e-mail addresses for the domain.
3. Timing
The Contest Period ("Contest Period"), i.e. run-time, for
each prize offering ends August 1st, 2006. Various Creative Presentations
may be added throughout the Contest Period. One (1) potential winner
for each prize will be drawn on or about August 1st, 2006. The drawing
("drawing") will be conducted by SwellWomen and will be
a random selection. The grand prize winner will be notified by e-mail
or phone and will have 3 days or 72 hours upon being notified to verify
their name and e-mail. If the winner does not respond by the allotted
time frame a new winner will be chosen. The winner will be announced
on www.swellwomen.com and via other media.
4. Prize
The prize is an all expense paid Experience including an airfare voucher
not to exceed $400 to either SwellWomen, SwellMates or SwellCo-Ed
in 2006. Winner will be sharing a room and placed in a double occupancy
cottage. Winner will be flown to Maui on the start date and flown
out the end date of the Experience. SwellWomen will pay $400.00 towards
the purchase of an airline ticket from the state or country that the
winner will be traveling from.
5. Privacy Policy
SwellWomen does not sell its Member list. We have a strict Anti-Spam
policy and will never sell, rent or otherwise give away your email
or any other private information.
SwellWomen, may use this information to send Entrants promotional
material specific to the individual company's products and services
via email or mail.
6. Additional Terms
By accepting a prize, winner agrees that SwellWomen, Sponsors and
Promoters, their respective parents, subsidiaries and affiliated companies,
and the agents, employees, directors or officers of these companies,
are not liable whatsoever for any injuries, losses or damages of any
kind resulting in whole or in part, directly or indirectly, from the
acceptance, possession, use or misuse of any prize. Winner is responsible
for any applicable taxes on prize, including luxury tax and GET tax
(4%). All entries are the property of SwellWomen, and none will be
returned. Neither SwellWomen, Sponsors nor Promoters are responsible
for any injury or damage to persons or property which may be caused,
directly or indirectly, in whole or in part, from downloading any
material from SwellWomen's, Sponsor's or Promoter's Web site, regardless
of whether the material was prepared by SwellWomen, Sponsors, Promoter,
or a third party, and regardless of whether the material is connected
to SwellWomen's, Sponsor's or Promoter's Web site by a hypertext link.
Participant agrees that: (1) any and all disputes, claims, and causes
of action arising out of or connected with this Contest, or any prizes
awarded, other than the administration of the Prize or the determination
of winners shall be resolved individually, without resort to any form
of class action, and exclusively by the United States District Court
for the District of Hawaii or the appropriate Hawaii State Court located
in Maui County, Hawaii; (2) any and all claims, judgments and awards
shall be limited to actual out of pocket costs incurred, including
costs associated with entering this Contest but in no event attorneys"
fees; and (3) under no circumstances will entrant be permitted to
obtain awards for and entrant hereby waives all rights to claim punitive,
incidental and consequential damages and any other damages, other
than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. SOME JURISDICTIONS
DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL
OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSIONS MAY
NOT APPLY TO YOU. All issues and questions concerning the construction,
validity, interpretation and enforceability of these Official Rules,
or the rights and obligations of the participant, SwellWomen, Promoter
and Sponsors in connection with the Contest, shall be governed by,
and construed in accordance with, the laws of the State of Hawaii,
without giving effect to any choice of law or conflict of law rules
of provisions (whether of the State of Hawaii, or any other jurisdiction),
which would cause the application of the laws of any jurisdiction
other than the State of Hawaii. All federal, state and local laws
apply.
